WORK PERMIT IN TURKEY
According to the International Labor Law No. 6735, foreigners must obtain permission before starting dependent or independent work in Turkey.
Permit holders of the foreigner employers can apply for a work permit to the Ministry of Interior for those foreigners who has resident permit from the Interior Ministry in Turkey which lasts for at least 6 months.
There are some conditions for work permit applcation. Please find the most important conditions below;
- There must a five-person Turkish citizen employment requirement for the employer/workplace for requesting a Work Permit.
- The paid-in capital of the workplace must be at least 100,000 TL or its gross sales must be at least 800,000 TL or the export amount in the last year must be at least 250,000 USD.
- It is obligatory that the foreign partner of the company requesting permission must have at least 20 percent of the capital, not less than 40,000 TL.
- The amount of monthly wage declared to be paid to the foreigner by the employer must be at a level compatible with the foreigner’s duty and competence. The employer has to pay the determined minimum wages.
- Permit holders of the foreigner employers can apply for a work permit to the Ministry of Interior for those foreigners who has resident permit from the Interior Ministry in Turkey which lasts for at least 6 months.
- It is obligatory that the foreign partner of the company requesting permission must have at least 20% of the capital, not less than 40,000 TL.
In the entire application process, the Foreigner is represented by Attorneys, with the power of attorney. Power of Attorney draft is especially prepared by Attorneys.
This power of attorney should be issued in one of the following three ways;
-May be issued in notary public offices within the border of Turkish Republic,
-may be issued in local notary public offices in the country you are currently located, should be Apostilled after taking the Ministry of Foreign Affairs approval,
-may be issued with a sworn translator from the Turkish Consulate of your country.
There are generally two steps;
1-Residence Permit Application
2-Work Permit Application
The foreigner must apply for a 6-month residence permit. Residence permit application is made according to the visa type of the foreigner. For this reason, foreigners who come to Turkey with a tourism visa apply for a tourism residence permit.
Please note that, the applicant has to stay in Turkey on the application day till the approval day.
After getting a residence permit, we will apply for work permit. There are 3 types of work permit;
- Periodical Work Permit
In cases where it is deemed appropriate by the Ministry, it can be taken for a maximum of 1 year at the first application.
- Independent Work Permit
Applications for extensions can be made for +2 years, provided that they are at the same workplace, and +3 years for those who have completed 3 years in the same workplace, provided that they are in the same profession.
- Permanent Work Permit
Long-term residents, who have been granted a residence permit legally in Turkey for at least 8 years, or those who have obtained a legal work permit for at least 8 years, can apply for an indefinite work permit.
Documents will be shared for work permit. All the work permit process will be handled by attorneys. The end of the process the work permit card is delivered to the foreigner.
Foreigners holding a work permit can apply for an extension from 60 days before the expiry of their work permit, and in any case before the expiry of the work permit. Extension applications made after these deadlines are not accepted.
